1. Agreement to Terms

By accessing and using TechFisc's website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this site or our services.

2. Services Description

TechFisc provides ecommerce development, maintenance, support, and tax compliance services for businesses operating in USA, UK, and Dubai markets. Our services include but are not limited to:

• Tax compliance setup and management
• Website maintenance and technical support
• Performance optimization and security services
• Free Ecommerce store & Website's audit services

3. Eligibility

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of its terms and conditions.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that you exit from your account at the end of each session

5. Payments and Billing

Payment terms will be specified in individual service agreements. General payment terms include:

• Projects may require an initial deposit before work begins
• Recurring services are billed monthly/annually in advance
• Late payments may incur additional charges
• All fees are exclusive of taxes, which will be added to invoices
• Refund policies vary by service and will be detailed in service agreements

6. Intellectual Property Rights

Unless otherwise stated, TechFisc and/or its licensors own the intellectual property rights for all material on our website. Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable license to access and use our services for your business purposes.

7. Service Level Agreements (SLAs)

Specific service levels and response times will be detailed in individual service agreements. Standard service levels include:

• Emergency Support: Response within 2 hours for critical issues
• Standard Support: Response within 24 hours for non-critical issues
• Uptime Guarantee: 99.9% for hosting and maintenance services
• Update Schedule: Regular security and feature updates as specified

8. Limitation of Liability

To the maximum extent permitted by law, TechFisc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

9. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us to close your account.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms, the breach thereof, or the use of our services shall be resolved through the following process:

1. Negotiation: Parties agree to attempt to resolve disputes through good faith negotiations for at least 30 days
2. Mediation: If negotiation fails, parties agree to submit the dispute to mediation
3. Arbitration: If mediation fails, disputes shall be settled by binding arbitration in Dubai, UAE

13. Third-Party Services

Our services may integrate with or provide links to third-party websites or services that are not owned or controlled by TechFisc. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that TechFisc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

14. Force Majeure

We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
